1. Scope of Application

1.1 These Terms of Use apply to all users (hereinafter referred to as "Users") of the website of the Constantin Hering Foundation for Homeopathic Medicine, hereinafter referred to as the "Constantin Hering Foundation" (trust foundation under the auspices of Hamburger Stiftungstreuhand e.V., Board of Directors Dr. Jörg Verstl and Carsten Müller, entered in the Register of Associations of the Hamburg Local Court under: 23988) with the address: Constantin Hering Stiftung für homöopathische Medizin, Schießplatzstr. 38a, 90469 Nürnberg, Germany, office[at]constantin-hering-stiftung.com.

1.2 The Constantin Hering Foundation is the operator of this website.

2. User Agreement

2.1 These General Terms and Conditions of Use apply to all content and services offered by the Constantin Hering Foundation as part of the online services (e.g. information provision in the browser, downloads or newsletters) on the website of the Constantin Hering Foundation (hereinafter referred to as Services). By using the Services, the User accepts the validity of these Terms of Use. The same shall apply to Services that do not require registration.

3. Proper Use

3.5 Users are not permitted to present the services of Constantin Hering Stiftung to other Users as advertising in any form for commercial purposes. This also applies to the setting of corresponding links, e.g. in forums.

3.6 In case of improper use, Constantin Hering Stiftung reserves the right to legally pursue such cases.

4. Warranty for Contents and Liability

4.1 The Constantin Hering Foundation is not responsible for the contents of the Web Site and disclaims any liability for damage of any kind caused by the intentional or negligent conduct of its Users as well as for damage resulting from ordinary negligence of the Users. This applies in particular to personal injuries that could be associated with the use of the web content. The above limitations of liability shall also apply to breaches of duty by the legal representatives or vicarious agents of the Constantin Hering Foundation.

4.2 Links - Third parties may create links to other websites or sources. Since the Constantin Hering Foundation has no control over such websites and sources, it is not responsible for them and is in no way liable for their content being free of errors, lawful or functional. 5. Additional usage agreements for registered users

5.1 As a registered web user, you agree to the terms of use by registering and logging in for the first time.

5.2 All content/downloads for registered users are not accessible to the public. They are intended for private use in practice and working groups only. Any further use, e.g. for publications, seminars, editing or distribution is not permitted without the written consent of the Board of Directors of the Constantin Hering Foundation.

6. Usage Agreement for Authors for Publications on the Internet Platform of the Constantin Hering Foundation for Homeopathy (CHS)

Preliminary remarks

The Constantin Hering Foundation for Homeopathy (abbreviated: CHS) intends to publish scientifically based content free of charge on its website. The content will be published in German, English, Spanish and later also in French. The offer is primarily aimed at medical professionals, in particular doctors, alternative practitioners and midwives. For this purpose, works (texts including graphics, images and photos) by various authors are published on the CHS website, for which the following terms of use apply:

6.1 The author grants the Constantin Hering Foundation for Homeopathic Medicine free of charge the exclusive use of his/her work for publication on the CHS website, unlimited in time and space. The publication of the content is carried out in agreement between the Constantin Hering Foundation for Homeopathic Medicine and the respective author.

6.2 The author's intellectual property rights to his work remain unaffected. Authors may, of course, continue to use and edit their material independently, with reference to the publication and correct citation.

6.3 To ensure the quality and consistency of the published content, we kindly ask all authors to coordinate with CHS before publishing their submitted content elsewhere.

6.4 The author grants the Constantin Hering Foundation for Homeopathic Medicine the right to additionally translate and publish their work in other languages (German, English, Spanish). (see also Imprint)

6.5 The author assures that their work is free of third-party rights and is being made available for publication on the website of the Constantin Hering Foundation for Homeopathic Medicine.

7. Data protection

7.1 As a user of any kind, you have read and accepted our privacy policy.

7.2 To secure our Internet presence and to optimize loading times, we use the service CloudFlare as a so-called content delivery network (CDN). The data mentioned in the privacy policy under the item CloudFlare are collected for the purposes mentioned and may also be stored on the servers of the company Cloudflare (currently located in the USA). The security measures of the company Cloudflare can be read at: https://www.cloudflare.com/de-de/trust-hub/gdpr/. The data can only be viewed and processed by authorized persons. If further data is required, it needs the consent of the user again separately. An (automatic) deletion of the collected data takes place after a limited period of time.

8. Conclusion of contract

8.1 The contract between the User and the Constantin Hering Foundation is concluded by the use of the Website (reading and downloading of information).

8.2 The contract between registered users and the Constantin Hering Foundation is concluded by the registration as user of this website by means of the registration dialog. For registered and logged in users, for example, extended content may be made available for download.

8.3 The contract between the user as editor and the Constantin Hering Foundation is concluded by written informal application to admin[at]constantin-hering-stiftung.com and the first login with the usage data transmitted by the admin.

8.4 Consent by the party concerned - By concluding the contract, the user assures that he/she consents to the collection and processing of his/her data by the Constantin Hering Foundation for Homeopathic Medicine for the respective purpose of use and voluntarily and that he/she has been informed about the data processing and his/her rights.

9. Right of revocation

9.1 The undersigned has the right to revoke this consent at any time with effect for the future without stating a reason. An e-mail to office[at]constantin-hering-stiftung.com is sufficient for this purpose. The lawfulness of the processing carried out on the basis of the consent until the revocation is not affected by the revocation.

9.2 Consequences of not signing - The user has the right to not agree to this declaration of consent when entering the site - however, since our service / the event is dependent on the collection and processing of the data mentioned at the beginning, a non-signature would preclude the use of the service.
